All my West Coast listeners know Bernie Ward from his years as the Lion of the Left on KGO/San Francisco.
And you all know that he is serving 6+ years in federal prison on a child pornography conviction. While it’s clear that Bernie broke the law, it is a draconian law that deserves reform. I, for one, decline to judge him; he is paying a heavy price and is certainly punishing himself. His deal with the prosecutor included an understanding that Bernie would serve his sentence in California, either in Dublin or Lompoc. But without warning, he was transferred by plane to Oklahoma City followed by a 12-hour bus ride to “Bloody Beaumont”, in Texas, which is considered one of the worst low security prisons in the nation. This strikes me as a kind of “rendition” to gratuitous extra punishment, as Bernie’s family can’t afford to travel there very often. The rates for phone calls from prisons are jacked up, so it really strains family connections.
Bernie did a lot of good work on his late-night show, the Sunday God Talk, and the charity work he devoted so much energy to. I’m glad to see that there are some human beings (I use the term loosely) that are really in the spirit of the season. Remember, “there except for the grace of God go I.”
It is sick and sadistic hypocrisy to kick a man when he is down. I also will not judge Bernie Ward, who did much good for homeless and disadvantaged people. Never mind what he did to “graphic images.”
I didn’t follow the case well enough to have an opinion about it.
But I listened to Bernie’s God Talk for many years and was personally very encouraged and uplifted by it.
So, I send my best wishes out to Bernie.
If is is guilty I pray that this will be a time of healing and personal rebirth.
If he is innocent, I pray for vindication.
In any case, I pray for justice.
There are very famous people who are getting away totally unpunished for doing far worse than Bernie. Because of this I can forgive him and hope that he can forgive himself. The fact that his family still wishes to visit him speaks positively about him.

True to form; I can now send Bernie a card and will offer to send him a book of his choice. Needless to say, I was disappointed to see the dilemma he found himself in. The station were his worked for so many years showed their true colors. Talk about kicking a man when he is down!
We all deal with pressure in different ways. It is not easy to see your country transforming into a neo-fascist state. His insights in regard to state and national politics was brillant. The time and effort he spent in reading and research was obviously monumental. I even warmed up to his Sunday show. No small achievment for an ex catholic. His illness crys out for treatment. I have followed what has happened to you thanks to Chistine Craft whom I admire very much.
I don’t understand what you did. Here in Japan, individuals are allowed to keep any kind of porno, including the type of which you did, without criminal liability. If one distributes it, then liability occurs–but usually minor–fines and prison terms (suspended).
So you are paying a very harsh penalty. Meanwhile killers and drug dealers get off with far less.
I never missed your program over here in Tokyo. I dearly hope that when you are free again, that your voice can be heard again on air.

I always looked forward to your show. You did a wonderful job keeping yourself and us informed on the issues. Truth, justice, freedom, and plain old fair play were always paramount in your arguments. A reactionary Neanderthal caller, arguing from a point of ideology and fantasy, could never address or compete with your grasp of the facts. Most of all, it was a true educational experience listening to your program.
Thanks for all the work you’ve done to raise money for the Thanksgiving Charities. Every year you put out a tremendous effort to help feed the needy.
Our current fascist government went after you with the same fervor only reserved for its most out spoken and virulent critics. You joined the ranks of Phil Donahue, Bill Maher, Eliot Spitzer, Joe Wilson, Valerie Plame, Scott Ritter, Helen Thomas, The Dixie Chicks, Gov. (AL) Don Siegelman, Mark Cuban, and the eight attorney generals (David Iglesias) who wouldn’t go along with the fascist agenda to suppress the vote, through hyping voter fraud or targeting Democrats. There is no question that the federal U.S. attorney went out of its way when it saw an opportunity to suppress a voice of truth. An individual, not afraid to speak truth to power. You were a true threat to this administration, because you spoke the truth.
We miss you Bernie. I will write to you and expect to hear you back on the air some where in the future. There is and was no substitute for your insights and program. I hope these draconian laws get changed and your sentence gets reduced.

To all of you out there in cyberspace defending/excusing/forgiving/decriminalizing/ and rationalizing Bernie’s guilt, hypocrisy and corruption: try to imagine for a minute how you’d feel if those sick, twisted pics of perversion and sadism he found so titillating had been taken of one of your own children? Of your little girl or boy? Are you saying no harm has been done? That this is essentially a “victimless crime” and that Bernie should’ve gotten off with a small fine and suspended sentence? And Bernie didn’t just hoard his little stash of kiddie porn..no, he quite enthusiastically and happily shared it with others for the better part of year. Ask Professor Pat what choice he would make if he had to choose between having a nude picture of his child sent by email or having the child blown up. I can’t believe it. We’ve gone from pro-Bernie apologies to pro-Hamas propoganda. Don’t blame Israel for defending itself. For years, Hamas sent rockets into Israel which struck and killed Israeli women and children. You need to read the transcripts and see what exactly it was Bernie was doing before you decide his punishment was too harsh. According to court documents, he received and sent out literally hundreds of photographs of children. The court papers describe some of the photos in graphic detail, and include descriptions that the children were being tortured in some photographs. He is no innocent bystander. His “research” defense was absolutely blown to pieces in the court briefs. He is LUCKY to be at any prison with a minimum security rating. He deserves hard time and I hope he suffers. In fact, please post his address - I would like to write him a letter, too. I have a few words to “cheer him up.”

Excerpts:
Defendant belonged to a list group of individuals who would trade images of child
pornography with one another. (PSR ¶10) These emails typically would have no accompanying
text and would just contain an image.
The images defendant received and sent included numerous images depicting very young
prepubescent minors (3-9 years old), typically females, engaged in sexual acts, graphically
depicted, with adult males. The sexual acts included vaginal and anal intercourse, as well as oral
sex. In some images, the minors are depicted bound by rope or handcuffs and are either being
forced to perform fellatio on an adult male or are being digitally penetrated. In one image, a
minor approximately 9 years old is being whipped.
The probation officer reviewed 17 of the images defendant either sent or received via his
AOL email account. According to her, the photos involved primarily female minors including:
1) a female toddler posing next to a penis, 2) an image of a penis penetrating a young female’s
vagina, 3) a series of six images showing a girl copulating an adult male, 4) a young girl tied up
with her mouth taped and her legs spread apart displaying her vagina, and 5) a young girl tied up
with rope. (PSR ¶15). 100 photos were involved in the instant offense.
Also:
impact and seriousness of his conduct.
This man sent and received horrific images of small children being bound, gagged, and
brutally sexually abused. He engaged in this conduct with at least 10 other individuals. The
method in which he traded these images does not reveal any indication that he was engaging in a
journalistic enterprise. The images were sent and received without discussion. Defendant
willingly traded in this currency of suffering children, contributed to each child’s cycle of abuse,
and facilitated the dissemination of their horrific record of sexual abuse. Once these images were
sent by defendant, he had no control over them any longer and could not undo the harm.
Moreover, in the context of his trading with Sexfairy2005, he discusses his sexual attraction to
his own children’s friends in his home. While this maybe fantasy, it is certainly inconsistent with
a journalistic enterprise. Finally, in his statement to his longtime friend, he says he engaged in
this behavior for approximately one year, knew it was wrong, but mentions nothing about doing
it for journalism. To all of this, defendant states he feels “chagrined about the instant offense and
wishes he had known more before getting involved in his research efforts.” (PSR ¶2 1). The
defendant’s argument should be regarded for what it is - a baseless, last-ditch effort to minimize
his culpability and salvage something of his reputation in the community.
If the photos/images(?) were truly as horrendous as stated the lives of the children referenced in the descriptions would truly be in danger. This would mean there would have to be an all out law enforcement program to track down the people creating these images to save the lives of these kids. No evidence that such an effort has been made is forthcoming. Nobody, in this “ring” of pornography distributors has been prosecuted or even identified even though 3 years had passed and many attempts at entrapment could have been made. Where is the due diligence of investigators of this crime?
It is also known that malicious email programs can send pornography out under an innocent person’s name. Anybody who knows the web knows that a mistaken click can send out many files that are not intended for distribution, sometimes without the person’s knowledge etc. etc.
Since Bernie approached no child (these are “thought crimes”) it is customary to give someone with Bernie’s integrity and record of good deeds the benefit of the doubt on the first offense and impose a very light sentence.As must have been done with the others in the “ring”.
Also the interview I saw of Bernie’s “friend” revealed to me a rather unstable individual with an obsession about sexual matters.This often happens in child molestation cases (see the McMartin Preschool trial records)
This case has all the earmarks of political vendetta associated with it.
By Bernie Ward viewing kiddie porn, he helped create a market for this garbage! Further, he distributed it!! Demented.
And if he was writing a book, where was the Manuscript? Ward has never written a book. He also has several brothers who are lawyers; if he asked them about his potential “research”, I am sure they would have given him a smack down in 2 seconds flat. It’s lies, to cover up lies, to cover up lies.
I usedto think that Ward’s growing anger was an act… for ratings. But when the slam-dunk verdictcame down, his wife was caught in a delusional political rant… just like him! It was something like this: “There are murderers out there,and they go after my husband for politican reasons? George Bush wanted to shut up my husband, what a load of blank, blank, blank… the Feds were out to get Bernie because of the failed policies of George Bush… he hasfailed, his presidency has failed… … …” This is NOT an exact quote, and many portions of it may be off, but it gives you an idea of what she said, and how twisted her (and his) logic is.
So let me get this straight… b/c Bush is screwing up, it’s OK to trade in horrific kiddie porn pics? Like I said, delusional. (And she’s a doctor?)
If I’m correct, Bernie also had a few years added to his sentence b/c he showed a lack of contrition.

First of all, if you actually followed my advice and took the time to READ THE TRANSCRIPTS you would see that many of the photographs have long been identified, including the people in them.
Second of all, there is no benefit of the doubt to give Bernie Ward because this was not some computer program sending kiddie porn out on his computer! Ward himself ADMITTED to receiving and sending the photos! Was it a computer program that was chatting online about molesting his kids and his kid’s friends? You didn’t read the transcripts, so you obviously are IGNORANT to the OVERWHELMING evidence against Bernie. This is not a case of mistaken identity or phony photos. The judge in the case saw the photos at the request of the prosecution just so that the judge knew what she was dealing with. She agreed, saw them, and it must have affected her sentencing, as it should have. This is a sick man who was distributing images too sick to even imagine.
I too am shocked and saddened by what Bernie Ward did. I can’t understand it and it scares me that someone who did so much good could turn around and do something so terrible. I suppose that is why I have to remind myself what Jesus and others taught about forgiveness.
Bernie was so popular with so many people because he somehow resonated as being “one of us”. He wasn’t attractive, nor was his voice all that wonderful. He was kind of smart, but very much a smart-ass too. He was interesting to listen to, especially in the late 80’s and 90’s. I think he lost a lot of his talent as his addictions took over, probably.
So now that he has admitted to doing something horrible, what does that say about “us”? Could anybody with time on their hands and an ability to justify their behaviors do the same? I keep reading these posts that Bernie was a sicko — and obviously he was just that, no doubt — but isn’t part of the label a way to say “not like us, not like me”. What causes a person to justify looking at child porn and sending it to others? I don’t know, thank God, but that doesn’t mean I don’t wonder how it happened and how the goodness and the badness of a person can co-exist side by side for so long…until “the dark side” takes over.
Bottom line: my prayers are with Bernie and with his family…and to the victims as well. All are deserving of our thoughts and prayers, Bernie no less than the others. Maybe one day they will discover what causes a person to slip over the edge and then there can be a cure or a way to prevent it.
Bernie is a disgrace to the human race. Read the sentencing report and you will see what a heinous person he is - read his incontrovertible deeds, not the hypocrisy he spewed as a third-rate talkshow radio host. His actions are indefensible and merit a much longer incarceration than the light 7 year sentence he received for trafficking in such truly vomit-inducing HARDCORE kiddie porn with kids as young as nine having vaginal and anal intercourse with adult males. He even admits that he fantasized sexually about his own kids’ young friends (and probably about his own kids as well).
Nobody should feel the least bit sorry for this scumbag. The travesty is that he is only doing 7 years and at a low security facility with dorm-style living (each inmate gets a cubicle of their own). FCI-Beaumont-Low is one of the newest facilities (built in mid-90s) in the BOP system. His “work” will consist of doing light labor to support the adjacent Medium FCI and high security USP - mostly unloading trucks, doing laundry, landscaping, hauling trash, unpacking and sorting supplies, mowing the lawns with riding mowers, and a lot of easy stuff.
USP Beaumont is a tough place, but where Bernie is at - FCI-Beaumont-Low it is a cakewalk in one of the newest facilities with 2 baseball fields, a very nice 1/4 mile track, and food that is better than most of our servicemen overseas get.
Bernie should not be pitied, although he is a pitiful excuse for a human being.
Great post, Mark…From your description, it sounds like FCI-Beaumont-Low is far from being some sort of terrible Siberian gulag, as some of the pedophile apologists on this board would have us believe. In fact, it sounds like a very nice country club–a place I wouldn’t mind working out at at the end of the day.
I just read the transcript, including all the pages of chat by Bernard Ward. I will continue to write to him whenever I find myself thinking of him. I believe doing this will interest you, also.
Remember, we have been taught “Judge Not!” by someone who was in a position to know that the one who is into judgment of another suffers as much as the person being judged.
Let me share with you some words of Bernard Ward, which I am copying from his letter to me of January 3rd, 2009, sent after he had received two note cards from me:
“I wish I had done the best I could at every moment but I lost sight of that and replaced it with arrogance and pride and ego. I thought I could do no wrong. I thought I was bullet proof. Rules were for someone else. I crossed lines I shouldn’t have crossed, thinking the 1st amendment was going to protect me. If I had loved my family more I never would have taken the risks I took. I meant no one any harm, but that doesn’t matter now.”

“I hope one day I will be forgiven. Then, I hope one day I can forgive myself.”

“Thank you for telling me I am not alone. Christmas was very hard for me. THe separation from my family and the loneliness were profound. I couldn’t shake the sadness that engulfed me. I have been sad now for months. … I pray that I can remain a good man and that I will get another chance someday if I can survive this.”

I do not judge your actions. I do not listen to KGO much any more. Not only because of you, but because I have found more intellegent talk radio, with a few exceptions. We all have sins and I believe you have been punished far too harshly. It serves to show that the modern American justice system is unjust and favors white collar corruption and those with money. I am a poor student and I will write and send stamps. The most vile criminals in this nation are free and openly committing crimes IMO. I wish the best for you and your family. President Obama will pardon Bernie — NOT!
Of course I’ve read (and reread the transcripts). There is not a single thing in all of the (prosecutors only) transcripts that show Bernie did anything that in any way harmed any child. Finding a person obnoxious is not sufficient reason to incarcerate him/her. If you look at civil law no damages can be assessed against anybody unless specific harm can be proven. This is also a provision of English common law. It was obvious from the transcripts that both correspondents were spouting nonsense and neither person believed what the other was saying. I doubt that they were even fantasies.
Please go to Wikipedia.com and read the excellent article “McMartin Preschool Trial” This occurred in the 1980’s and was the longest trial in US history in which 3 generations of a family were charged with 321 counts ranging from sodomy to “satanic ritual abuse”. After 6 years all charges were dropped and the teachers recovered their credentials. This trial caused a 10 year hysteria in the US over using children for Satanic ritual abuse - a campaign that has simply disappeared. A similar case is the “Little Rascals” trial in North Carolina.
The charges against Bernie nowhere come close to the above indictments. In Japan what Bernie did would not even be considered a misdemeanor - and, yes, the Japanese love their children.
All of our civil rights are threatened by this sort of hysterical law enforcement. Not to mention rights of free speech!

I miss you. So many other people miss you. KGO has not been able to find another person to fill your shoes. Although, KGO has been trying very hard to do so. I have learned so much from you. Thank you so much. On KGO, there is a black hole in progressive programming without you. You have touched so many people… Your intellect and gift of gab combined with a mind that functions like a steel trap has made many a neoconservative a pile of mincemeat. (And I really cheered every time!)
I don’t know the truth about your legal situation. I pray that you are not being persecuted for your vociferous progressive views. I wish for you that justice will be served for you. If you are guilty, I pray for deliverance and healing. {Therapy does work if you have faith and hope.) I hope that this terrible yoke will be taken off your back. Once again Professor Pat, you didn’t answer the question, “Why Bernie is in jail but Mark Foley(whose has physical contact with his interns who were boys by the way)got off scott free? If what he did wasn’t wrong, why didn’t Foley fought back like Barney Frank did when he was accused of running a ring of call boys at his home? Foley knew he was guilty of something that is against the law, that’s why he resign and went to “rehab” without being arrested? Then years after people forgot what Foley did, the charges against him were drop. Bush & his powerful GOP friends may had help Foley got off. The story about the charges against Foley were dropped was under the radar by the press. I wonder why? If you break the law your ass should be in jail if you democrat or republican. There’s a double standard going on here.
